RENTAL EQUIPMENT PRICING & SELECTION

Current to 4th Dec 2009.

We hire out the following products on a weekly or monthly basis, minimum rental is one week:

• Shower stools/Chairs
• Standard Wheelchairs (self propel)
• Transit wheelchairs (attendant propel)
• Walking frames & sticks
• Elbow (Canadian) or Underarm Crutches
• Over toilet frames
• Mobility scooters
• Day chairs (high back or low back)

• Electric wheelchair is minimum 3 months hire
• Electric hospital bed comes with hospital grade mattress & minimum 3 month hire

Deposit is required for ALL products going out as well as ID with current address noted on it.

Terms and Conditions
PLEASE READ CARFULLY BEFORE SIGNING

1. In these conditions “Owner” means EAMB Enterprises t/a Mobility And You and “Hirer” means any person, corporation or company who shall hire any goods from the Owner
2. Extreme care whilst moving on the equipment is expected whilst at Farm Fantastic due to large numbers of patrons
3. Excessive speed will not be tolerated and any such action seen by the Owner its servants or agents will result in immediate cancellation of hire period and any funds associated with the hire period
4. NO ONE is to use or ride the equipment other than the Hirer in any circumstance without prior authority from the Owner its servants or agents
5. All care is to be taken when cornering by slowing down on speed
6. All care is to be taken due to uneven ground conditions and some ‘soft’ areas (heavily saw dusted patches, etc) due to ground maintenance by event organisers
7. Remain within the booking period assigned to assist others who may be waiting to use equipment
8. ANY damage caused to equipment or other person, property etc the Hirer will be referred back to clause 4 in the Conditions of Hire
9. Only a single person to be seated on equipment at any given time

Conditions of Hire
PLEASE READ CARFULLY BEFORE SIGNING

1. In these conditions “Owner” means EAMB Enterprises t/a Mobility And You and “Hirer” means any person, corporation or company who shall hire any goods from the Owner
2. An additional charge and/or extra charge is payable by the Hirer where equipment is returned late or where equipment is returned in a dirty or damaged condition (the Hirer will pay the current replacement costs for equipment (fixed by a copy of the Suppliers invoice to the Owner) which is returned irreparable (the sole judge of which shall be the Owner) whether due to neglect of the Hirer or any other reason
3. INDEMNITY – The Hirer shall indemnify and keep indemnified and save harmless the Owner and the Owner’s servants and agents from all damages, suits, actions, claims and demands of every description whatsoever and howsoever arising directly or indirectly from the use, maintenance, transport, operation of the goods or otherwise and whether resulting from the negligence of the Owner, it’s servants or agents or otherwise
4. EXCLUSION OF LIABILITY – The Owner shall not be liable to the Hirer or the Hirer’s servants, agents for any damages, suits actions, claims and demands of every description whatsoever or howsoever arising either directly or indirectly form the representations, warranties, terms and conditions, express or implied (except in so far as statutory conditions and warranties cannot be excluded under relevant State Legislation) use, maintenance, transport, operation of the goods or otherwise and whether resulting from the negligence of the Owner its servants or agents or otherwise
5. OPERATIONS OF CLAUSES 3. & 4. – Clauses 3. & 4. Hereof to the extent they are inconsistent with other clauses, terms and conditions of this agreement are to override such clauses and be of paramount force
6. Hirer to grant access to Owner for repair, examination or recovery of equipment in event of Hirer default
7. The Hirer grants irrevocable permission for the Owner to enter upon any premises or property where the equipment is stored to recover the same. Where pick up by the Owner is agreed, equipment shall be stacked and located in an accessible position/location for pick up and easy loading by the Owner or its servants, agents; any expense incurred by the Owner in this regard will be payable by the Hirer
8. Refunds will only be made at the discretion of the Owner which shall be absolute
9. Trading terms are C.O.D. In addition to any other rights of the Owner all payments not made when due and payable (including additional charges for repair or return charges for replacement, charges for extension of hire, or otherwise) shall bear interest on the amount outstanding form time to time at the rate of two (2) percent per calendar month (or part thereof) from the date upon which payment should have been paid until payment in full is made
10. Goods not to be shifted from address hereon without consent of the Owner. Goods received under terms specified hereon
